The duty can fall on owners, landlords, occupiers or others with responsibility for maintenance or repair of non-domestic premises or common parts of multi-occupancy domestic premises.
Does Regulation 4 apply inside private homes?
It does not normally apply inside an owner-occupied private home or individual flat, but it can apply to common parts of multi-occupancy domestic premises.
Is a survey the same as a management plan?
No. The survey provides information. The dutyholder must maintain a register, assess risk, set actions, communicate information, control work and keep the plan under review.
How often should the management plan be reviewed?
HSE guidance says it should be reviewed at least every 12 months or sooner if circumstances change. Individual ACM checks should be risk-based.
Does asbestos in good condition need removal?
Not automatically. It may be managed in place where condition is good, disturbance is unlikely and effective controls can be maintained.
