Who has the duty to manage asbestos?
The duty normally sits with the person or organisation responsible for maintenance and repair of non-domestic premises, including relevant common areas of some domestic buildings. Contract terms and actual control both matter.
How often should asbestos be reinspected?
There is no universal interval suitable for every material. Set the frequency according to risk, condition, location and likelihood of disturbance, and inspect sooner after damage, works or other material change.
Is an asbestos register the same as a survey?
No. A survey provides evidence at a point in time. The register is the maintained record used to communicate known and presumed materials, while the management plan defines responsibilities and actions.
Do landlords need an asbestos management plan?
Where the duty to manage applies to non-domestic premises or relevant communal areas, the dutyholder must make and keep an up-to-date plan for managing the risk.
Can contractors use a management survey before refurbishment?
Not as clearance for intrusive work. A refurbishment survey must cover the complete work area and the building elements that will be disturbed.
